A 14-year-old student from a secondary school in Bandar Utama has been charged in the Petaling Jaya Magistrate’s Court with the murder of a female student.

The charge was read before Magistrate Amira Sariaty Zainal. However, no plea was recorded as murder cases fall under the jurisdiction of the High Court.

The charge was filed under Section 302 of the Penal Code.

As the case involves a juvenile, the proceedings were held in private with only the teenager’s family allowed in the courtroom.

According to the charge sheet, the teenager is accused of murdering a 16-year-old female student in the school toilet at Sekolah Menengah Kebangsaan (SMK) Bandar Utama Damansara (4), Bandar Utama, between 9:20 a.m. and 9:35 a.m. on October 14. A kerambit and two knives were confiscated as evidence.

Deputy Public Prosecutors Raja Zaizul Faridah Raja Zaharudin, Aqharie Durranie Aziz, and Nur Sabrina Zubairi represented the prosecution.

Lawyer Anwar Ezzad Zainal represented the accused.

Earlier, the teenager arrived in a police van at around 8:30 a.m. He was escorted into the court complex through an alternative entrance to avoid the media waiting in the lobby.

The case is set to be heard on November 21.

No death penalty for juveniles even if charged for murder

If convicted, the offender may be sentenced to death by hanging or imprisonment for not less than 30 years and not more than 40 years, and not less than 12 lashes.

Although Section 302 of the Penal Code provides for the death penalty upon conviction, Section 97(2) of the Child Act provides that the death penalty for minors under the age of 18 shall be commuted to imprisonment with the approval of the Head of State.

Which means, he will be sentenced to detention at the approval of the Yang di-Pertuan Agong (YDPA), the Ruler, or the Yang di-Pertua Negeri, depending on the state where the offence was committed.

The victim was cremated on Oct 20

Over a hundred family members, friends, and even members of the public attended Yap Shing Xuen’s funeral on October 20. The scene was described as emotional when Yap was sent off with a hundred balloons of her favourite colour, blue.
